Terms of Service

Effective Date: August 29, 2026
Last Updated: August 29, 2026

These Terms of Service ("Terms") govern your access to and use of Hyperion Tarot (the "Service"), operated by Codex Dev ("we", "us", or "our"), located in the Netherlands. By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

The Service provides an interactive platform for generating and interpreting tarot card spreads using self-hosted artificial intelligence models. The Service is provided free of charge, with optional voluntary donations. We reserve the right to introduce optional premium tiers or quota structures in the future.

2. Entertainment Purposes Only (No Professional Advice)

The Service is provided strictly for entertainment and reflective purposes only.

  • The interpretations, text, and insights generated by the Service do not constitute medical, psychological, psychiatric, legal, financial, tax, or professional advice of any kind.
  • You should never make critical life, medical, financial, or legal decisions based on the outputs of this Service.
  • If you are experiencing physical or mental health distress, medical symptoms, or financial difficulties, you must seek the care of a licensed professional.

3. User Responsibility for Inputs and Outputs

  • Sole Responsibility for Inputs: You are solely responsible for all questions, text, statements, and spread data you submit to the Service ("Inputs"). You represent that your Inputs do not violate any applicable law or infringe on the rights of any third party.
  • Sole Responsibility for Outputs: The text, responses, and interpretations generated by the system ("Outputs") are automated algorithmic responses driven entirely by the probabilistic processing of your Inputs. Codex Dev exercises no editorial control over real-time Outputs and disclaims all liability for the content, accuracy, suitability, or consequences of any Output. You assume full responsibility and risk for your use of, or reliance upon, any Output.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Transmit content that is illegal, abusive, threatening, defamatory, or promotes self-harm or violence.
  • Attempt to reverse engineer, decompile, overwhelm, or launch denial-of-service attacks against our infrastructure.
  • Circumvent rate-limiting controls, quotas, or authentication mechanisms.
  • Access the Service using automated scrapers, bots, or unauthorized API clients.

Violation of this policy may result in immediate suspension or termination of your access without notice.

5. Google Authentication & Account Security

You are responsible for safeguarding access to the Google Account you use to log in to the Service. You must notify us immediately at [email protected] if you suspect any unauthorized access or breach of security.

When you use Google sign-in, Google returns an authentication ID token that includes your Google account name, email address, and profile picture. Hyperion stores only your email address for authentication, access control, and rate-limiting purposes, as described in our Privacy Policy.

6. Voluntary Donations and Future Paid Services

  • Donations: Users may choose to support the Service through voluntary donations processed via Stripe. Donations are non-refundable and do not grant any equity, ownership, exclusive rights, or express warranty regarding future uptime or features.
  • Future Subscriptions / Quotas: We reserve the right to offer paid subscription tiers or enhanced rate limits in the future under separate or updated commercial terms.

7. Intellectual Property

  • Our Rights: The Service, including our underlying software, interface design, brand identity, and proprietary code, remains the exclusive property of Codex Dev.
  • Your Rights: As between you and Codex Dev, you retain all ownership rights in your Inputs. Because session data is not permanently retained by our servers, you are responsible for locally saving any Outputs or interpretations you wish to keep.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted availability, or non-infringement. We do not warrant that the Service will be error-free, secure, or free from unintended system downtime.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Codex Dev, its developers, or its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, emotional distress, personal injury, loss of profits, or business interruption, arising out of or in connection with your use of, or inability to use, the Service or any generated Outputs.

To the extent permitted by law, our total aggregate liability for any claims arising under these Terms shall not exceed the total amount paid by you to us (if any) in the twelve (12) months preceding the claim, or €50 (fifty euros), whichever is less.

10. Indemnification

You agree to indemnify, defend, and hold harmless Codex Dev from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, your Inputs, or your misuse of the Service.

11. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts located in the Netherlands.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this document. Continued use of the Service after any modification constitutes your acceptance of the updated Terms.
